Please read these Terms and Conditions carefully, as they contain important information regarding your legal rights, remedies, and obligations, and in using this website or app, you are deemed to have read and agreed to the following Terms and Conditions.

The Lagree Red website and app allow users to receive information about Lagree Red, as well as book classes, cancel, and pay for services and products offered at Lagree Red.

BOOKING POLICY

To book a class at Lagree Red, you must have a valid membership to reserve a spot. To buy an individual class credit or membership you can either sign up on www.LagreeRed.com by using your email and creating a password or if you are already registered, click login to buy a class credit or membership and make your reservation.

Please download the Lagree Red App to your iPhone or Android before coming to the studio. If you do not have a phone, please come to the front desk at the studio at least 10 minutes before the start of your class or appointment and we’ll check you in there. If you do not check in, we may release your spot to another guest 5 minutes after the start of class. DO NOT ASSUME THE FRONT DESK STAFF KNOWS YOU ARE IN ATTENDANCE. Additionally, checking in for other clients is prohibited.

CANCELLATION POLICIES

To cancel a Lagree Red class or infrared sauna appointment, you may do so without penalty by canceling online, via the mobile app, the website, or by calling the studio (760-612-5212) NO LATER THAN 12 HOURS before your scheduled class. If you cancel your spot within 12 hours of your class, you will be charged a $10 late cancellation fee. All cancellations must be done on the Lagree Red website or the Lagree Red app. Cancellations via electronic mail (email), Facebook Messenger, Instagram, or text message will not be accepted, and you will be charged.

NO-SHOW POLICIES

Should you no-show to a Lagree Red class or sauna appointment you reserved using an unlimited membership, you will be charged a $20 no-show fee.Please be aware that we release your spot EXACTLY five minutes after the start of class or the start of your scheduled infrared sauna session to those on the waitlist. If you are running late, please call the studio and speak with a front desk staff member to ensure we hold your spot.

WAITLIST POLICY

If you book multiple classes or waitlist multiple classes, you are solely responsible for canceling your classes within the bounds of the cancellation policy. The Lagree Red staff cannot be held responsible for accidental bookings by clients or double bookings or double waitlisted classes made by clients. Late cancel and no-show fees apply if you do not cancel within the bounds of the cancellation policy for double bookings.

The system will auto-populate clients into class from the waitlist as other clients with confirmed spots cancel and Megaformers or infrared saunas will be assigned as such.

The Lagree Red staff will add walk-in, waitlisted clients in the order in which they were added to the waitlist by the computer system, top to bottom, and EXACTLY 5 minutes after the start of class. There is no waitlist priority given for early arrival.

SOCKS REQUIRED FOR LAGREE WORKOUT

For safety and sanitary purposes, Lagree Red requires that all clients wear socks during class. Although not required, grip socks are HIGHLY recommended. We sell a variety of grip socks at the studio for purchase for your convenience.

RETURN AND EXCHANGE POLICY

All retail items are final sale. No returns or exchanges.

AUTO-DEBITED CONTRACTS & UNLIMITED MEMBERSHIPS

The following terms and conditions apply if you are enrolled in a membership or other auto-debit contract:

I, the Client, authorize Lagree Red to, on a recurring basis, automatically charge the debit or credit card account I specified, for monthly payments due on my unlimited auto-debit plan associated with my account. I understand that Lagree Red will initiate transfers/charges pursuant to this authorization not to exceed the amount shown on my auto-debit contract and/or in connection with cancellation fees according to the Lagree Red cancellation policy. Lagree Red will initiate charges on the date my contract is set to renew. Lagree Red may discontinue processing of recurring charges if the Company is unable to secure funds from my debit or credit card that I have authorized due to, but not limited to, insufficient or uncollected funds in the account or insufficient or inaccurate information I provided.

CANCELLING

You may cancel any Lagree Red membership at any time with 30 days notice, unless you signed up under a promotional program that requires a certain minimum number of months. Memberships are billed on a month to month basis. You can call Lagree Red if you need assistance with cancellations. By continuing to use our services, you agree to the statements above regarding auto-debited contracts and memberships.

COOKIES

A cookie is a small text file that is sent to your browser from a website and stored on your computers hard drive. Cookies cannot read data from your hard disk or read cookie files that were created by other sites. This website uses cookies to obtain certain types of information, such as your username and password, to customize content areas or to analyze site activity and user behavior. Lagree Red reserves the right to use cookies in the future in conjunction with new content or expanded functionality.

This privacy policy outlines the type of information we receive and collect when you use the features on our website as well as some of the steps that we take to safeguard the information. COLLECTION OF INFORMATION

We collect personally identifiable information, such as names, phone numbers, postal addresses, email addresses, credit card information, etc. when it is voluntarily submitted by our members and/or visitors. If you use this website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept sole responsibility for all activities that occur under your account or password.

Your personally identifiable information is kept secure. Only authorized employees, agents, and contractors who have agreed to keep information secure and confidential have access to this information. All emails, phone calls, mobile text messages, and newsletters from this site allow you to opt out of future marketing communication. We use industry-standard efforts to safeguard the confidentiality of your personal information, including the use of firewalls and secure sockets layer software where appropriate. We do not sell your information to anyone.

Lagree Red reserves the right to refuse, terminate accounts, remove or edit content, or cancel orders at their sole discretion.

WAIVER AND RELEASE

When you visit Lagree Red or send emails to us, you are communicating with us electronically, and therefore consent to receive communications from us electronically. We will communicate with you by email or by posting notices on our website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

By signing up for and/or attending Lagree Red classes, activities and other programs, and using Lagree Red premises, facilities, and equipment (collectively, Classes and Facilities), you hereby agree that there are certain inherent risks and dangers in working out inside Lagree Red and exercise equipment and infrared saunas in association with the Classes and Facilities. Please be aware that working out inside Lagree Red can be harmful and result in injury. In consideration of being allowed to participate in and access the Classes and Facilities provided by Lagree Red, in addition to the payment of any fee or charge, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Classes and Facilities, (2) waive, release and forever discharge Lagree Red, its officers, agents, members, employees, representatives, and all others from any and all responsibility, claims, rights, causes of action and/or liability from injuries or damages to your person or property resulting from your participation in and use of the Classes and Facilities, and (3) represent you have no medical or physical condition which would prevent you from attending and/or using any of Lagree Red Classes and Facilities and/or put you in any physical or medical danger, and have not been instructed by a physician not to do so. In addition, if in the opinion of Lagree Red staff, you would be at physical risk using Lagree Red Classes and Facilities, you will be denied access to Lagree Red and its classes and facilities until you furnish Lagree Red with an opinion letter from your medical doctor, at your sole cost and expense, specifically addressing Lagree Red concerns, and stating that Lagree Red concerns are unfounded.

An inherent risk of exposure to COVID-19 exists in any public place where people are present.COVID-19 is an extremely contagious disease that can lead to severe illness and death. By visiting Lagree Red, you voluntarily assume all risks related to exposure to COVID-19.

Lagree Red may photograph and record you. They may publish and distribute these photographs and recordings in connection with your participation in Lagree Red activities and your attendance at Lagree Red. By acknowledging these terms, you agree and consent that Lagree Red may display these photographs and recordings through our website and social media channels.

INTELLECTUAL PROPERTY RIGHTS

 “Lagree Red”, “Resculpt, Recover, Rejuvenate” and other graphics, logos, designs, page headers, button icons, scripts are service marks, trademarks, and/or trade dress of Lagree Red and may not be used by you for any other reason other than as expressly permitted by these terms. You have the right to view, electronically copy, and print in hard copy portions of this Website for the sole purpose of making class reservations or other personal use. Any other use of the materials on this Website without the prior written permission of Lagree Red is strictly prohibited.

DISCLAIMERS

In no event shall Lagree Red, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (1) errors, mistakes, or inaccuracies of content, (2) personal injury, illness or property damage, of any nature whatsoever, resulting from your access to and use of our website, (3) any unauthorized access to or use of our secure servers an/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from our website, (5) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our site by any third party and/or (6) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Lagree Red website or app, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.
